1. General information on the use of our Ofa online shop/Partner Portal

We are pleased that you are using our Ofa online shop/Partner Portal and thank you for your trust.
The protection of your data and privacy when using our portal is important to us. Therefore, we always endeavour to act in accordance with the applicable legal provisions on the protection of personal data and to take adapted data security measures.

Below we inform you in detail about the handling of personal data on this portal by the responsible provider, Ofa Bamberg GmbH (hereinafter also referred to as "Ofa", "we" or "us").

1.1 Term "personal data"

Personal data are individual details about personal or factual circumstances of a specific or identifiable natural person. For example, the name of a specialist dealer, address of a specialist dealer, e-mail address of a specialist dealer, telephone and fax number of a specialist dealer, name of an end customer, address of an end customer, order data of an end customer or the IP address of your computer are personal data. Non-personal data, on the other hand, is data with which it is impossible to determine an actual identity. This includes, for example, information about your gender or the browser you use.

1.2 Storage of access data and recommendation for secure passwords

We know that you place a great deal of trust in us by registering. By registering, you have the opportunity to view and download access-restricted content on the website "portal.ofa24.de" using your customer number and personal password.

At this point, we would like to expressly request you to immediately change the password provided by Ofa for the initial registration, as otherwise access restriction will not be granted. When assigning your own password, please note the "Recommendations for the assignment of secure passwords" provided by us in the login screen.

For reasons of data security, in particular to protect your customer data, we ask you to enter a complex password.
Each time you access our Partner Portal and each time you retrieve a file, access data about this process is stored in a log file on the corresponding server of our provider.

This data record consists of:

  • Your IP address
  • Date & time of access
  • Name of the requested file
  • Name of the file from which the file was requested
  • Message as to whether the request was successful
  • Amount of data transmitted
  • Description of the web browser and operating system used

This data is collected exclusively for data security and statistical purposes and stored for a period of 90 days.

For statistical evaluations, an anonymised version of the access log (i.e. by shortening or making the IP address unrecognisable) is retained for a further 2 years.

No personal evaluation of any kind takes place. Access to the log data is generally not possible for unauthorised third parties.

1.3 Data transmission between your computer system and the Ofa online shop/Partner Portal

Data is transmitted exclusively via state-of-the-art encrypted connections (http via SSL, TLS with strong encryption standards).

All transmitted data cannot be viewed by third parties using current technical means.

1.4 Purpose of data processing and transfer to third parties

We store and use the personal data that you provide to us in a correspondence (see point 1.1) - subject to further consent or legal permission - for the use of the functions of the Ofa online shop/Partner Portal and for customer support.

We do not disclose any personal data to third parties unless we are required to do so by law or you have given us your prior consent.

Insofar as we make use of service providers for the implementation and handling of processing procedures, the contractual relationships will be regulated in accordance with the provisions of the applicable data protection legislation.

We and any service providers commissioned by us receive access to the user's personal data in order to use it for the above-mentioned purposes of the technical operation of the portal and for the use of the portal functions.
We do not use personal data from the Ofa online shop/Partner Portal for advertising purposes.

If you have consented to the use of data for advertising in any form within the scope of our business relationship, you may revoke this consent at any time by contacting Ofa Bamberg GmbH (at: export@ofa.de or the contact address below).

1.5 Download area

In our Partner Portal, you have the option of downloading image material from Ofa Bamberg for advertising purposes.

The image material provided is protected by copyright. Therefore, you can only download it if you accept the applicable terms of use.

If you agree to the terms of use, the following data will be stored by us as a result of your consent:

  • Name and customer number
  • Address and e-mail address
  • Date and time of download
  • Copy of the right of use
  • Copy of the downloaded file
  • URL of the downloaded file

This is necessary to ensure compliance with copyright laws. By agreeing to the terms of use, you also agree that we may inform you about new image material when the rights of use expire.

You can revoke your consent at any time by sending an email to marketing@ofa.de. With your revocation, the agreement for the use of the image material in question expires.

2. Competitions/Prize competitions

Insofar as no further consent is given by the participant, the personal data collected by us in the context of competitions/ prize competitions will be collected, processed and used solely for the design, implementation and/or processing of the competition/ prize competition and deleted again after processing.

Data will not be passed on to third parties. Further information can be found in the respective conditions of participation for our competitions and prize draws.

3. Newsletter (not provided and not relevant for Export partners)

When you register for our newsletter, your data (e-mail address) will be used by us to send you information about our products and services.

When you open the newsletter or click on a link in it, this is logged by our web server (date, time, e-mail address). This is for internal statistical purposes. This data is not combined to form personal user profiles.
You can unsubscribe from the newsletter service at any time using the unsubscribe link provided in the newsletter.

4. Links to other websites

We occasionally refer to the websites of third parties. Although we select these third parties carefully, we cannot accept any guarantee or liability for the correctness or completeness of the content or the data security of third-party websites. Nor does this privacy policy apply to linked third-party websites.

Social media

We maintain online presences within social networks and platforms in order to communicate with the customers, interested parties and users active there and to be able to inform them about our services there.

We would like to point out that user data may be processed outside the European Union. This may result in risks for the users because, for example, it could make it more difficult to enforce the rights of the users. With regard to US providers certified under the Privacy Shield, we point out that they thereby undertake to comply with EU data protection standards.

Furthermore, user data is usually processed for market research and advertising purposes. For example, usage profiles can be created from the usage behaviour and resulting interests of the users. The usage profiles can in turn be used, for example, to place advertisements within and outside the platforms that presumably correspond to the interests of the users. For these purposes, cookies are usually stored on the users' computers, in which the usage behaviour and the interests of the users are stored. Furthermore, data independent of the devices used by the users may also be stored in the usage profiles (especially if the users are members of the respective platforms and are logged in to them).

The processing of the users' personal data is based on our legitimate interests in effectively informing users and communicating with users pursuant to Art. 6 para. 1 lit. f. DSGVO. If the users are asked by the respective providers for consent to the data processing (i.e. declare their consent e.g. by ticking a checkbox or confirming a button), the legal basis of the processing is Art. 6 para. 1 lit. a., Art. 7 DSGVO.

In the case of requests for information and the assertion of user rights, we would also like to point out that these can be asserted most effectively with the providers. Only the providers have access to the users' data and can take appropriate measures and provide information directly. If you still need help, then you can contact us.

5. Cookies

To facilitate the use of our portal, we use "persistent cookies". Cookies are small text files that can be stored by your browser on your computer's hard drive and are helpful for using our portal.

We use cookies to better understand how our portal is used and to provide improved navigation. Cookies help us to determine, for example, whether a page of our portal has already been visited.

Cookies also allow us to recognise whether you have visited our portal before or whether you are a new visitor. These cookies do not store your personal data.

It is also possible to view our portal under exclusion of cookies. If you do not want cookies to be stored on your computer, you will be asked to deactivate the corresponding option in the system settings of your browser. Stored cookies can be deleted in the system settings of the browser.

However, the exclusion of cookies can lead to functional restrictions of this online offer.

6. Analysis tools

6.1 Google Analytics

This portal uses Google Analytics, a web analysis service of Google Inc. (hereinafter "Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

In the event that IP anonymisation is activated on this website, however, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the portal, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator.

The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

Demographic characteristics

This portal uses Google Analytics demographic reports, which use data from Google's interest-based advertising and third-party visitor data (e.g. age, gender and interests). This data cannot be traced back to a specific person and can be deactivated at any time via the ad settings.

6.2 Other analysis tools

Your personal data as well as transaction data on our portal may be collected and stored by us or third parties such as Smartsupp.com, s.r.o., VAT ID CZ03668681. 7. Your rights as a user

If you no longer agree to the storage of your personal data or if this data has become incorrect, we will arrange for the deletion or blocking of your data or make the necessary corrections (insofar as this is possible under the applicable law) on the basis of a corresponding instruction.

Upon request, we will provide you with information about all personal data we have stored about you.
